Vietnam: Elaboration of the Law on Emulation and Commendation 2022 for ethnic affairs sector

On March 15, 2024, the Minister and Chairman of the Committee for Ethnic Affairs issued Circular 01/2024/TT-UBDT detailing the implementation of certain provisions of the Law on Emulation and Commendation 2022 concerning the ethnic affairs sector.

Elaboration of the Law on Emulation and Commendation 2022 for the ethnic affairs sector in Vietnam

- Circular 01/2024/TT-UBDT elaborates on Clause 4 Article 24; Clause 3 Article 26; Clause 3 Article 27; Clause 3 Article 28; Clause 2 Article 71, Clause 6 Article 74; Clause 2 Article 75 and Clause 6 Article 84 of the Law on Emulation and Commendation 2022 in the ethnic affairs sector in Vietnam.

- Circular 01/2024/TT-UBDT applies to collectives, officials, public employees, and workers in the ethnic affairs system; organizations and individuals who have made contributions to the cause of building and developing ethnic affairs.

Commendation application in the ethnic affairs sector in Vietnam

- The composition of the application for consideration for awarding emulation titles and forms of commendation shall comply with the provisions of the Law on Emulation and Commendation 2022 and regulations of the Government of Vietnam.

- The application for consideration for awarding emulation titles and forms of commendation under the jurisdiction of the Minister or head of a ministry (original), must also be sent as electronic file attachments (word and pdf files) to the Standing Committee of the Emulation and Commendation Council of the Committee for Ethnic Affairs in Vietnam (Department of Personnel and Organization; email: vutochuccanbo@cema.gov.vn), except for documents containing state secrets; the submission deadline is before December 15 annually and dossiers should also be submitted via the online public service portal as regulated.

- The application for thematic commendation: Immediately after the collective or individual achieves a feat, the head of the unit is responsible for submitting it to the Minister, Head of the ministry for review and decision or to the Minister, Head of the ministry for submission to the competent authority for review and decision.

- The application for commendation according to emulation movements, thematic commendations, and establishment anniversaries: Immediately after the end of the emulation movement or thematic event and on the occasion of establishment anniversaries, the head of the unit selects outstanding collectives and individuals for submission to the Minister, Head of the ministry for review and decision or submission to the competent authority for review and decision.

- The application for consideration for awarding the Commemorative Medal as prescribed in the appendix attached to this Circular must be sent to the Standing Committee of the Emulation and Commendation Council of the Committee for Ethnic Affairs in Vietnam (as stipulated in Clause 2 of this article) by March 31 annually.

- The application for consideration for awarding emulation titles and forms of commendation under the jurisdiction of the Heads of agencies or units with legal status under and subordinate to the Committee for Ethnic Affairs in Vietnam shall be stipulated by such units.
