Vietnam: Determining the origin of goods during transit and transshipment in CPTPP

This content is specified in Circular No. 03/2019/TT-BCT on rules of origin in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), which was issued on January 22, 2019 by the Ministry of Industry and Trade of Vietnam.

According to Circular No. 03/2019/TT-BCT of the Ministry of Industry and Trade of Vietnam, an originating good retains its originating status if the good has been transported to the importing Party without passing through the territory of a non-Party.

Moreover, if an originating good is transported through the territory of one or more non-Parties, the good retains its originating status provided that the good:

- does not undergo any operation outside the territories of the Parties other than: unloading; reloading; separation from a bulk shipment; storing; labeling or marking required by the importing Party; or any other operation necessary to preserve it in good condition or to transport the good to the territory of the importing Party.

- remains under the control of the customs administration in the territory of a non-Party.
