Recently, the Ministry of Transport of Vietnam issued Circular 07/2021/TT-BGTVT stipulating judicial expertise in the field of transportation.
According to Circular 07/2021/TT-BGTVT, the criteria for appointing judicial experts in the field of transportation from June 1, 2021 in Vietnam is as follows:
Vietnamese citizens permanently residing in Vietnam who fully meet the criteria specified in Clause 1, Article 7 of the Law on Judicial Assessment 2012 and do not fall into the cases specified in Clause 2, Article 7 of the Law on Judicial Assessment 2012 may be considered for the appointment of judicial experts in the field of transportation.
Thus, according to Vietnam's Circular 07/2021/TT-BGTVT, from June 1, 2021, a person who is considered for the appointment of a judicial expert in the field of transportation must satisfy two conditions: have enough statutory standards and not be in the following cases:
Being prosecuted for criminal liability; being convicted without a criminal record for an unintentional crime or an intentional less serious crime; being convicted intentionally of a serious crime, a very serious crime, or a particularly serious crime;
Being subject to administrative handling measures for education in communes, wards, or townships; being sent to compulsory detoxification establishments; or being sent to compulsory education establishments.
(Currently, Vietnam's Circular 33/2014/TT-BGTVT does not stipulate the above cases)
