Contents of inspection of responsibility for implementing the law on inspection from August 15, 2024

Specifically, Article 9 of Circular 07/2024/TT-TTCP stipulates the contents of inspection responsibility for implementing the law on inspection as follows:

- Content of state management on inspection

+ Advisory work, construction, issuance, and guidance on implementing regulations on inspection organization and activities under the authority (if any);

+ Implementing the responsibilities of the Head of the state management agency, the Head of the agency performing the inspection function according to the provisions of the Inspection Law 2022 of Vietnam;

+ Implementing policies on information and reporting;

+ Establishing, managing, exploiting, using, and storing inspection files and other contents according to the provisions of the law on inspection.

- Inspection activities

+ Organizing the construction of inspection plans, issuing inspection plans, and implementing inspection plans;

+ Performing the duties and rights of the Deciding Inspector, Chief Inspector, and other members of the Inspection Team during the inspection process;

+ Exercising authority to issue inspection decisions; developing and approving plans to conduct inspections; complying with inspection deadlines; the order and procedures for carrying out an inspection; reporting inspection results; concluding inspections, publicizing inspection conclusions; handling violations related to inspection and monitoring, urging, and checking the implementation of inspection conclusions, recommendations, and handling decisions;

+ Supervising the activities of the Inspection Team, verifying the draft Inspection Conclusion;

+ Implementing the responsibilities of the Head of the same-level state management agency in issuing documents organizing the implementation of inspection conclusions and directing the implementation of inspection conclusions; handling or requesting and recommending the competent agency to handle economic violations; handling or requesting and recommending the competent agency to handle officials and public employees with legal violations; applying or requesting and recommending the competent agency to apply remedial measures, complete mechanisms, policies, and laws.

More details can be found in Circular 07/2024/TT-TTCP effective from August 15, 2024.

Circular 07/2021/TT-TTCP stipulating the authority and content of inspection responsibility for implementing the law on inspection, citizen reception, complaint, denunciation, and anti-corruption will cease to be effective from the date Circular 07/2024/TT-TTCP becomes effective.
