Vietnam: Circular No. 06/2021 amending regulations on compulsory social insurance

On July 07 2021, Ministry of Labor, War Invalids and Social Affairs issued Cirular No. 06/2021/TT-BLĐTBXH amendment to Circular No. 59/2015/TT-BLĐTBXH guiding the implementation of some articles of the Law on Social Insurance of Vietnam on complusory social insurance.

 

Circular No. 06/2021 supplemented provisions on the maximum time of rest and recovery in a year to Clause 1 Article 7 Circular No.  59/2015, particularly:

- The number of days of a leave for convalescence and health rehabilitation shall be jointly decided by the employer and grassroots Trade Union Executive Committee, or by the employer in case the grassroots Trade Union has not yet been set up, specifically as follows:

+ 10 days at most, for employees whose health has not yet recovered after suffering a disease requiring long-term treatment;

+ 7 days at most, for employees whose health has not yet recovered after undergoing an operation;

+ 5 days, in other cases.

- Determination of maximum time for rest and recovery in a year shall be based on the latest sick leave prior to taking rest and recovery (illnesses requiring prolonged treatment or illnesses as a result of surgery or other illnesses).

Circular No. 06/2021/TT-BLĐTBXH takes effect from September 01 2021.
