Vietnam: An applicant for the permit for access to genetic resources must obtain at least a bachelor’s degree

According to Decree No. 59/2017/NĐ-CP of Vietnam’s Government on management of access to genetic resources and benefit sharing arising from their utilization: The applicant for the permit for access to genetic resources who is an individual shall:

- Obtain a degree (at least a bachelor’s degree) in either Biology, Biotechnology, Pharmacy or Agricultural Science;

- Act as a member of a science and technology institution operating as prescribed in regulations of a country where such institution was established and receive a written guarantee from such institution.

Application for the permit for access to genetic resources shall include:

- A copy of the written approval;

- The Mutually Agreed Terms (MAT) concluded by and between the relevant parties and certified by the People’s Committee of commune;

- A written approval granted by the managing authority as stipulated in regulations of law if the genetic resources are included in a list of conditional genetic resources;

- Documents prescribed in Clause 2 Article 7 herein if the applicant is an individual.

- Professional degree and written guarantee of a science and technology institution.
