Vietnam: Amendments to cases eligible for receiving lump-sum social insurance payout

Circular 18/2022/TT-BYT issued by the Minister of Health on December 31, 2022 amends Circular 56/2017/TT-BYT on elaboration of the Law on Social Insurance and the Law on Occupational Safety and Hygiene in the healthcare sector in Vietnam.

Circular 18/2022/TT-BYT issued by the Minister of Health of Vietnam on December 31, 2022 amends Circular 56/2017/TT-BYT on elaboration of the Law on Social Insurance and the Law on Occupational Safety and Hygiene in the healthcare sector.

Cases of suffering diseases eligible for receiving lump-sum social insurance payout in Vietnam are specified as follows:

Except for cases of suffering from one of life-threatening diseases such as cancer, polio, dropsy cirrhosis, leprosy, severe tuberculosis, or HIV infection progressing into AIDS specified in point c clause 1 Article 60 of the Law on Social Insurance:

- A person suffering from diseases or illnesses that results in at least 81% of work capacity reduction or impairment level and total loss of the worker’s functions, self-control or he/she is unable to keep personal hygiene and complete other everyday tasks without other people watching, helping and taking care of him/her is fully eligible for lump-sum social insurance payout.

(Compared to Circular 56/2017/TT-BYT, this simplifies the case unable to move, dress, keep personal hygiene and complete other everyday tasks without other people watching, helping and taking care of him/herself;

The regulation regarding "diseases or disabilities not specified in clause 1, Article 4 of Circular 56/2017/TT-BYT that result in at least 81% of work capacity reduction or impairment level and total loss of the worker’s functions, self-control or he/she is unable to move, dress, keep personal hygiene and complete other everyday tasks without other people watching, helping and taking care of him/her" has been removed.)

Circular 18/2022/TT-BYT is effective from February 15, 2023 and amends Circular 56/2017/TT-BYT.
