Vietnam: Amendment to the procedures for issuing a permit for research and collection of intangible cultural heritage

Amendment to the procedures for issuing a permit for research and collection of intangible cultural heritage in Vietnam is specified in Decree 31/2024/ND-CP dated March 15, 2024, amending Decree 01/2012/ND-CP, Decree 61/2016/ND-CP and Decree 36/2019/ND-CP.

Amendment to the procedures for issuing a permit for research and collection of intangible cultural heritage in Vietnam

Decree 31/2024/ND-CP has made amendments to point a, clause 3, Article 2 of Decree 01/2012/ND-CP on the procedures for issuing a permit for research and collection of intangible cultural heritage in Vietnam at clause 2, Article 8 of Decree 98/2010/ND-CP as follows:

- Overseas Vietnamese, foreign organizations, and individuals requesting research and collection shall submit directly or send via postal mail or electronically 01 application set including an application form (Appendix I) accompanied by a Scheme (Appendix II) clearly stating the purpose, location, duration, and Vietnamese partners participating in the research and collection of intangible cultural heritage to the Director of the Department of Culture, Sports and Tourism/Director of the Department of Culture and Sports. If the research and collection cover two or more provinces or centrally-run cities, they shall submit directly or send via postal mail or electronically 01 application to the Minister of Culture, Sports and Tourism of Vietnam;

- Within 15 working days from the date of receipt of the application for the Minister of Culture, Sports and Tourism of Vietnam, and 10 working days for the Director of the Department of Culture, Sports and Tourism/Director of the Department of Culture and Sports, the heads of the above-mentioned agencies are responsible for reviewing and issuing the permits. In case of refusal, a written explanation must be provided.

(Meanwhile, clause 2, Article 8 of Decree 98/2010/ND-CP (amended at point a, clause 3, Article 2 of Decree 01/2012/ND-CP) on the procedures for issuing a permit for research and collection of intangible cultural heritage in Vietnam is as follows:

- Overseas Vietnamese, foreign organizations, and individuals applying for research and collection must submit directly or send via postal mail one (01) application set including an application form (Appendix I) accompanied by a Scheme (Appendix II) clearly stating the purpose, location, duration, and Vietnamese partners participating in the research and collection of intangible cultural heritage to the Director of the Department of Culture, Sports and Tourism. If the research and collection cover two or more provinces or centrally-run cities, they must submit directly or send via postal mail one (01) application to the Minister of Culture, Sports and Tourism of Vietnam;

- Within twenty (20) working days from the date of receipt of the application, the Minister of Culture, Sports and Tourism of Vietnam or the Director of the Department of Culture, Sports and Tourism is responsible for reviewing and issuing the permits. In case of refusal, a written explanation must be provided.)
