Vietnam: Amending conditions for individuals providing consultancy on land pricing

Recently, the Government of Vietnam issued Decree No. 136/2018/NĐ-CP amending certain Decrees providing for regulatory requirements for trade and investment in the environment and natural resource sector.

Decree No. 136/2018/NĐ-CP of Vietnam’s Government amends the conditions for individuals providing consultancy on land pricing specified in Decree No. 44/2014/NĐ-CP (amended and supplemented by Decree No. 01/2017/NĐ-CP). Specifically, an individual can provide consultancy on land pricing if working for an organization whose function is to provide consultancy on land pricing and satisfying one of the following requirements:

- Possess a certificate in land valuation as regulated by the Law on land; or

- Possess a valuer certificate or certificate in real estate appraisal and certificate of completion of supplemental training in land valuation according to the Ministry of Natural Resources and Environment’s program for supplemental training in land valuation.

To be granted a certificate in land valuation, individuals must fully meet the conditions on civil act capacity; moral qualities; have a university degree or higher etc.; actual working time in specialized fields is 36 months or more etc. These conditions are specified in Circular No. 61/2015/TT-BTNMT of the Ministry of Natural Resources and Environment of Vietnam.
