Vietnam: Amending and supplementing procedures for “Supporting employees whose employment contract suspended or having to take unpaid leave due to Covid-19 pandemic”

Recently, the Ministry of Labor, War Invalids and Social Affairs of Vietnam has issued the Decision No. 1326/QĐ-LĐTBXH on the disclosure of administrative procedures amended and supplemented within the scope of State management functions of the Ministry of Labor, War Invalids and Social Affairs on the implementation of policies on assistance for people affected by Covid-19 pandemic.

Disclosed together with the Decision No. 1326/QĐ-LĐTBXH are administrative procedures amended and supplemented within the scope of State management functions of the Ministry of Labor, War Invalids and Social Affairs of Vietnam on the implementation of policies on assistance for people affected by Covid-19 pandemic.

In particular, this Decision stipulates the order of carrying out procedures for “Supporting employees whose employment contract suspended or having to take unpaid leave due to Covid-19 pandemic” as follows:

- Step 1: Enterprises and educational institutions shall make a list of employees whose employment contract suspended or having to take unpaid leave, ensuring the conditions as prescribed; request the grassroots trade union (if any) and the social insurance agency to certify this List;

- Step 2: Within 03 working days from the date of receipt of the List at the request of the enterprise or educational institution, the social insurance agency shall certify the employee's participation in social insurance as prescribed and send it to the enterprise or educational institution;

- Step 3: Enterprises and educational institutions shall send their application dossiers to the district-level People's Committees where their headquarters are located. Within 03 working days from the date of receipt of complete dossiers, the district-level People's Committees shall appraise and submit them to the provincial-level People's Committees;

- Step 4: Within 02 working days from the day on which the complete dossier is received, the President of the provincial People's Committee shall issue a decision approving the list and support funding; concurrently, directing the implementation of support payments.
