Vietnam: 41 new administrative penalty forms in civil aviation

On May 28, 2018, the Ministry of Transport of Vietnam issued Circular No. 34/2018/TT-BGTVT providing for the templates of minutes and decisions used to impose administrative penalties in the field of civil aviation, which include:

There are 28 templates for decisions, such as:

- Decision on administrative penalty;

- Decision on administrative penalty without minutes;

- Decision on postponing the execution of the fine;

- Decision on multiple fine payments;

- Decision on forced deduction of salary or income.

There are also 13 templates for minutes, such as:

- Minutes of administrative violation;

- Minutes of direct explanation on administrative violation;

- Minutes of forced collection of money or assets to execute the decision on administrative penalty;

- Minutes of verifying the circumstances of the administrative violation;

- Minutes of seizure of exhibits or vehicles related to the administrative violation.

In addition to the templates in Circular No. 34/2018/TT-BGTVT of the Ministry of Transport of Vietnam, other templates issued together with Decree No. 97/2017/ND-CP of Vietnam’s Government may also be applied.

Circular No. 34/2018/TT-BGTVT of the Ministry of Transport of Vietnam takes effect from July 15, 2018 and replaces Circular No. 53/2013/TT-BGTVT.
