Vietnam: 3 more cases of foreign workers exempt from work permits

On December 30, 2020, the Government issued Decree 152/2020/ND-CP on foreign workers working in Vietnam and recruitment and management of Vietnamese workers working for foreign employers in Vietnam.

According to Vietnam's Decree 152/2020/ND-CP, there are 3 more cases of foreign workers exempt from work permits that have not been mentioned before, including:

  • Person taking charge of establishing the commercial presence;
  • He/she is certified by the Ministry of Education and Training of Vietnam as a foreign worker entering Vietnam for teaching and research purpose;

  • Foreigners who marry Vietnamese and live in Vietnam.

In addition to the above three cases, the following cases also have changes compared to the current regulations, specifically:

  • Owners or capital contributors of a limited liability company with a capital contribution value of VND 3 billion or more (Previously, a capital contribution of 3 billion VND was not required).

  •  

    The Chairman of the Board of Directors or a member of the Board of Directors of a joint-stock company with a capital contribution value of 3 billion VND or more. (According to the old regulations, only a member of the Board of Directors of a joint-stock company is required).
