Vietnam: 02 forms in handling administrative violations in the transport sector

On December 1, 2022, the Minister of Transport of Vietnam issued Circular 30/2022/TT-BGTVT on regulations on forms and the management and use of forms for sanctioning administrative violations in the Transport sector. 

Thus, promulgating 02 forms of minutes used in sanctioning administrative violations in the transport sector, including:

- Form No. MBB01: Minutes of not receiving minutes of administrative violations.

- Form No. MBB02: Minutes of return of the license, practice certificate are kept.

In addition, Vietnam's Circular 30/2022/TT-BGTVT also guides the management of the above forms as follows:

- The agency performing the transport sector inspection function shall formulate, issue internal regulations, create a paper book or a computer-based form to manage the printing, allocation, use, and withdrawal, cancel, number the forms, and monitor the sanction of administrative violations;

- A damaged pre-printed form must be crossed out from the four corners, and the person performing the task of sanctioning administrative violations must have a written explanation clearly stating the cause with confirmation from the immediate superior and report to the head of the agency or unit;

- Damaged, unsold, and unused pre-printed forms must be destroyed; the destruction of the form shall be carried out in accordance with the law on archiving and shall be recorded in writing.

Vietnam's Circular 30/2022/TT-BGTVT takes effect from February 1, 2023, and replaces Vietnam's Circular 37/2017/TT-BGTVT, Circular 12/2016/TT-BGTVT, Circular 08/2018/TT-BGTVT, and Circular 34/2018/TT-BGTVT.
