Various Fraudulent Tactics and Counterfeits of Non-conformable Goods Origin

Recently, the General Department of Customs issued Official Dispatch 5189/TCHQ-GSQL on the inspection and determination of origin, combating fraud, counterfeit origin, labeling of goods, intellectual property rights infringements, and illegal transshipment.

The General Department of Customs has highlighted numerous methods and tactics of fraud and counterfeit in goods origin that are non-compliant, for example:

• For goods imported into Vietnam to be eligible for special preferential tariffs under Free Trade Agreements: Using fake Certificates of Origin (C/O), invalid C/Os during customs procedures; Incorrectly declaring information on C/Os to qualify for special preferential tariffs during customs procedures;…

• For goods exported from Vietnam: Vietnamese enterprises (including FDI enterprises) import raw materials, semi-finished products, components for manufacturing, processing, and assembling that do not meet origin criteria but declare Vietnam origin when exporting;...
