Use of VNeID for notification of civil judgment execution in Vietnam from January 1, 2025

This is the content mentioned in Decree 152/2024/ND-CP dated November 15, 2024, amending Decree 62/2015/ND-CP guiding the Law on Civil Judgment Enforcement, which was amended by Decree 33/2020/ND-CP issued by the Government of Vietnam.

Use of VNeID for notification of civil judgment execution in Vietnam from January 1, 2025

Notifications regarding enforcement as prescribed in Article 40, Article 41, Article 42 of the Law on Civil Judgment Enforcement shall be implemented for the first time. If the notified person agrees, from the second notification onwards, the civil judgment enforcement agency may conduct notifications via VNeID or the electronic portal of the Department of Civil Judgment Enforcement and the electronic portal of the General Department of Civil Judgment Enforcement under the Ministry of Justice.

If the notified person does not agree with the form of notification from the second time onwards, the civil judgment enforcement agency shall carry out notifications in accordance with the Law on Civil Judgment Enforcement.

For direct notifications to the parties involved, individuals with relevant rights and obligations shall be handled as follows:

- By the executor, official performing the task of executing judgments delivering notification documents to the notified person;

- By postal workers; individuals authorized by the enforcement agency; head of the neighborhood group; village, hamlet, hamlet, sub-village, settlement, or town leader; People's Committees, commune police; head of agency or unit; prison wardens, detention center wardens, head of the district-level criminal enforcement agency where the notified person has an address, residing, working, or serving a prison sentence, delivering the required notification documents to the notified person.

Thus, from January 1, 2025, civil judgment enforcement agencies may use VNeID for notifications of civil judgment enforcement from the second time if the notified person consents to this form.

More details can be found in Decree 152/2024/ND-CP effective from January 1, 2025.

Simultaneously, Item 3, Point d, Clause 2, Article 1 of Decree 17/2013/ND-CP amends and supplements a number of articles of Decree 204/2004/ND-CP on salary policies for officials and public employees and armed forces shall be repealed.
