On December 19, 2017, the Ministry of Information and Communications issued Circular 41/2017/TT-BTTTT stipulating the use of digital signatures for electronic documents in State agencies.
When digitally signing an electronic document, it must be done through digital signature software using a private key, specifically:
- In cases where an authorized individual is required to digitally sign an electronic document, through digital signature software, the authorized individual uses their personal private key to perform the digital signature on the electronic document;- In cases where an agency or organization is required to digitally sign an electronic document, through digital signature software, the office uses the private key associated with the agency's or organization's seal to perform the digital signature on the electronic document.
Additionally, it is worth noting that no later than 12 months from the effective date of Circular 41, agencies and organizations must upgrade or add digital signature software to meet the standards set forth in Circular 41.
Circular 41/2017/TT-BTTTT takes effect from February 5, 2018.
