Update on regulations regarding the declaration of conformity for products and goods with potential safety hazards in Vietnam from February 1, 2025

Amendments and supplements are made to Clauses 2 and 3, and Clause 5 is abolished in Article 5 of Circular 26/2018/TT-BLDTBXH, regulating the declaration of conformity for products and goods with potential safety hazards (also known as group 2 products and goods) under the state management responsibility of the Ministry of Labor, War Invalids and Social Affairs of Vietnam. To be specific:

(1) Group 2 products and goods under the state management responsibility of the Ministry of Labor, War Invalids and Social Affairs of Vietnam must be declared to conform with the corresponding national technical standards.

(2) The principles, procedures, dossiers, dossier handling regarding the declaration of conformity, and the responsibilities of organizations and individuals declaring conformity shall be implemented according to the regulations in Circular 28/2012/TT-BKHCN dated December 12, 2012, by the Minister of Science and Technology regulating the declaration of standard conformity, declaration of conformity, and the method of conformity assessment with standards and technical regulations as amended and supplemented by Circular 02/2017/TT-BKHCN dated March 31, 2017, by the Minister of Science and Technology amending and supplementing some articles of Circular 28/2012/TT-BKHCN.

(3) When declaring conformity, organizations and individuals manufacturing group 2 products and goods under the state management responsibility of the Ministry of Labor, War Invalids and Social Affairs must register the declaration of conformity at the Department of Labor, War Invalids and Social Affairs where the organization or individual registers their production and business operations according to the regulations in Clause 2, Article 14 of Decree 127/2007/ND-CP dated August 1, 2007, of the Government of Vietnam providing detailed guidance on the implementation of certain articles of the Law on Standards and Technical Regulations 2006.

(4) Organizations and individuals importing group 2 products and goods declare conformity through state inspection activities regarding the quality of imported products and goods.
