Update on Regulations for suspension of training activities of educational institutions in Vietnam from January 5, 2025

On November 20, 2024, the Minister of Education and Training of Vietnam issued Circular 12/2024/TT-BGDDT amending Circular 02/2022/TT-BGDDT which stipulates the conditions, order, and procedures for opening training programs, and suspending operations of training programs at undergraduate, master's, and doctoral levels.

Update on Regulations for suspension of training activities of educational institutions in Vietnam from January 5, 2025

The regulations on the suspension of operation of training programs in educational institutions in Vietnam from January 5, 2025, will include the following provisions:

(1) An educational institution will be suspended from enrolling students in a training program under the following circumstances:

- The program was opened conformably but has failed to maintain the full conditions for opening during its operation as stipulated in Circular 02/2022/TT-BGDDT;

- Violating other legal provisions on education to the extent that enrollment activities must be suspended.

(2) An educational institution will be suspended from conducting a training program under the following circumstances:

- Autonomously opening a training program or committing fraud to open a training program without ensuring the prescribed conditions;

- The expiration of the enrollment suspension period without rectifying the causes leading to the enrollment suspension;

- Violating other legal provisions on education to the extent that training activities must be suspended.

(3) The Minister of Education and Training will decide on the suspension of student enrollment or training activities for a program when there is a conclusion from the competent state management agency regarding violations as stipulated in (1) and (2); the duration of the suspension ranges from 6 to 12 months depending on the nature and severity of the violation. The suspension decision must clearly state the reasons, scope, and duration of the suspension and be publicly announced through mass media.

(4) An educational institution suspended from student enrollment or training activities for a program as regulated in (3) must implement measures to ensure the legitimate rights and interests of students, lecturers, managerial staff, and employees of the institution.

(5) During the enrollment suspension period, if the educational institution rectifies the causes leading to the suspension and meets all conditions for opening a program as stipulated in Circular 02/2022/TT-BGDDT, the Minister of Education and Training will decide to allow resumption of student enrollment for the program within 30 days from the end of the suspension period.

(6) During the training suspension period, if the educational institution rectifies the causes leading to the suspension and meets all conditions for opening a program as stipulated in Circular 02/2022/TT-BGDDT, the Minister of Education and Training will decide to allow the resumption of training activities for the program within 45 days from the conclusion of the training suspension period. If upon the expiration of the training suspension period, the institution does not provide sufficient evidence of having rectified the causes for suspension and meeting all conditions for opening the program, the decision to open the training program will become void.

(7) For a training program that has been opened but the institution neither organizes enrollment nor successfully enrolls students for five consecutive years, the decision to open the training program will become void.

(8) In the event that the decision to open a training program becomes void, if the institution wishes to continue enrolling and training this program, it must follow the process and procedures to reopen the program as stipulated in Circular 02/2022/TT-BGDDT and other relevant legal regulations.
