On November 01, 2019, the Ministry of Agriculture and Rural Development issued Circular 16/2019/TT-BNNPTNT detailing the implementation of certain articles of Decree 109/2018/ND-CP on organic agriculture.

According to Clause 1, Article 9 of Circular 16/2019/TT-BNNPTNT, it is mandatory to recall agricultural products under the cases specified in Clause 3, Article 13 of Decree 109/2018/ND-CP. Accordingly, organizations and individuals engaged in production and business are responsible for developing a plan to recall organic agricultural products that do not ensure quality.

The recall of substandard organic agricultural products is carried out in the following two forms:

- Voluntary recall by the production and business organizations and individuals;- Mandatory recall at the request of a competent state authority.

According to Circular 16, acts of non-compliance regarding the quality of organic agricultural products are handled in accordance with the provisions of the law on administrative violations and relevant regulations concerning product quality control, food safety.
