Transitional regulations on the value of the issued civil cryptographic product import-export license in Vietnam

Transitional regulations on the value of the issued civil cryptographic product import-export license in Vietnam are specified in Decree 32/2023/ND-CP promulgated on June 9, 2023.

Government of Vietnam issued Decree 32/2023/ND-CP amending Decree 53/2018/ND-CP amending Decree 58/2016/ND-CP, providing guidance on trading in civil cryptographic products and services and exporting and importing civil cryptographic products.

Replace Appendix II List of civil cryptographic products exported and imported under license in Decree 53/2018/NDCP with Appendix List of civil cryptographic products exported and imported under license, enclosed with Decree 32/2023/ND-CP.

For example, civil cryptographic products are exported and imported under license in Vietnam, such as:

- 84.43: Printers using printing parts such as printing plates (bowls), printing tubes and other printing parts of heading 84.42; other printers, copying machines, and fax machines, whether or not combined; parts and their accessories.

- 84.71: Automatic data processing machines and their function blocks; magnetic or optical readers, machines that transmit data onto data transmission media in an encrypted form, and machines that process these data, not elsewhere specified or included.

- 84.73: Parts and accessories (other than cases, containers, and the like) for use solely or principally with the machines of headings 84.70 to 84.72.

Transitional regulations on the value of the issued civil cryptographic product import-export license in Vietnam

If the license to export and import civil cryptographic products has been granted to an enterprise before the effective date of Decree 32/2023/ND-CP, then:

Continue to be valid for carrying out customs procedures according to the time limit stated in the License if the name of the product matches the description of the goods in the List of Vietnam's exports and imports.

The Customs Authority shall base itself on the list of exported and imported goods of Vietnam, the granted license to export and import civil cryptographic products, and the actual export and import goods to determine HS codes and handle customs clearance procedures for enterprises according to regulations.
