On June 9, 2021, the Supreme People's Court of Vietnam issued Dispatch 64/TANDTC-HTQT on judicial entrustment and delivery of procedural documents abroad.

According to the Official Dispatch, in order to request the Vietnamese Embassy abroad to serve procedural documents, the Supreme People's Court of Vietnam requires the Courts to:

  • Properly and fully implement the process in Vietnam's Joint Circular 01/2019/TTLT-TANDTC-BNG.
  • The court must forward the cost of serving legal documents to the Embassy in Vietnam. The embassy uses such expenses to pay the postage charges for sending the court's files to the involved parties and sending the results of service to Vietnam to the court.
  • If the process has been followed properly and it has been more than 3 months since the date the court sent the file for service but has not received the service result, the court shall proactively contact via email or send a document to the Embassy in Vietnam.
  • In case the Court only transfers the documents without pre-transferring the service costs, the service of the procedural documents to the involved parties will not be performed by the Embassy in Vietnam. The court must re-serve the procedural documents on its own for the overseas parties involved.
