On March 26, 2024, the Prime Minister of the Government of Vietnam issued Official Dispatch No. 202/TTg-NN to implement and enforce the Land Law 2024.

Land Law 2024 was passed by the 15th National Assembly of the Socialist Republic of Vietnam at the 5th extraordinary session on January 18, 2024.

The provisions of the Land Law 2024 will be in effect in Vietnam from January 1, 2025, except for the provisions effective from April 1, 2024.

However, with the desire to expedite the application of the Land Law 2024 ahead of schedule, the Government of Vietnam will propose to the National Assembly to allow the Land Law 2024 to take effect from July 1, 2024.

To support the above proposal, the Prime Minister of Vietnam has issued Official Dispatch 202/TTg-NN on March 26, 2024, regarding the implementation of the Land Law 2024.

The Prime Minister has mandated the Ministry of Natural Resources and Environment to lead and cooperate with the Ministry of Justice and other relevant agencies to present to the Government of Vietnam by March 31, 2024, a draft explanatory note (accompanied by the draft resolution of the National Assembly) to be submitted to the National Assembly for approval to allow the Land Law 2024 to take effect from July 1, 2024.

Additionally, the Ministry of Natural Resources and Environment of Vietnam is tasked with submitting to the Government of Vietnam decrees and drafting and issuing circulars within its authority. To be specific:

To submit Decrees

- Decree detailing the implementation of certain provisions of the Land Law 2024;

- Decree on basic land investigation; registration, issuance of certificates of land use rights, ownership of properties attached to the land, and land information systems;

- Decree on compensation, support, and resettlement when the State recovers land;

- Decree on land pricing;

- Decree on sea encroachment;

- Decree on administrative sanctions in the field of land.

To issue Circulars

- Circular on technical regulations for land investigation, assessment; techniques for land protection, improvement, and rehabilitation;

- Circular on land statistics, inventory, and mapping of land use status;

- Circular on cadastral records, certificates of land use rights, and ownership of properties attached to the land;-

Circular on the content, structure, and format of national land database information.
