Time to receive citizens of the Chief Procurator of the People's Procuracy in Vietnam

On June 22, 2023, the Chief Procurator of the Supreme People's Procuracy issued Decision 222/QĐ-VKSTC on the Regulation on citizen reception, settlement of complaints and denunciations and supervision of the settlement of complaints and denunciations in judicial activities in Vietnam.

Time to receive citizens of the Chief Procurator of the People's Procuracy in Vietnam

Procurators of procuracies at all levels shall directly receive citizens according to the following provisions in Vietnam:

- Periodically every month, directly contact citizens at least 01 day for the following cases:

+ The case has been resolved in writing with legal effect, but the citizen requests re-examination;

+ The citizen's case has been submitted many times, showing signs of injustice or error, which has attracted public attention but has not been considered and resolved.

- Unscheduled reception of citizens in the following cases:

+ The case is of a harsh and complicated nature, involving many people, involving the responsibilities of many agencies, organizations, or units, or the opinions of agencies, organizations, and units are still different;

+ The case, if not directed and considered in time, may cause serious consequences or may lead to the destruction of property of the State and collectives, infringing upon people's lives and properties, affecting security, politics, social order, and safety;

+ When the director is absent, a deputy director is authorized by the director to perform the task of receiving citizens.

Handling the case after the Chief Procurator of the People's Procuracy receives the citizen in Vietnam

Cases after the director receives citizens are handled as follows:

- If the case is considered by the accepting units, when there is a settlement document sent to the citizen, it must send 01 copy to the Procuracy and settlement of complaints and denunciations in judicial activities for monitoring and general management.

- If the case has been resolved in writing with legal effect but falls into the category that needs to be re-examined, after the inspection is finished, the units shall report to the Director the results of the examination in writing and send them to the Procuracy and settlement of complaints and denunciations in judicial activities to notify citizens.

- The unit that supervises and settles complaints and denunciations in judicial activities and related units shall organize the implementation of conclusions or other directives of the Director in respect of cases.

Decision 222/QĐ-VKSTC takes effect from June 22, 2023 and replaces Decision 51/QĐ-VKSTC-V12 dated February 2, 2016.
