Time to enjoy pension in case the original dossier is no longer available

The Ministry of Labor, War Invalids and Social Affairs promulgates Circular 37/2021/TT-BLDTBXH dated December 31, 2021 guiding the adjustment of pensions, social insurance allowances and monthly allowances, and the time of pension enjoyment for cases where they do not original file.

Accordingly, Vietnam Social Insurance considers and settles the calculation of working time for employees who do not have original documents showing the working time in the state sector before January 1, 1995 according to the guidance of the Ministry of Health. Labour, Invalids and Social Affairs.

At that time, the time to enjoy pension in case the original dossier is no longer available is the time stated in the settlement document of the Vietnam Social Insurance .

In addition, the pension, social insurance allowance and monthly allowance for the subjects specified in Clause 2, Article 1 of Circular 37/2021/TT-BLDTBXH from January 1, 2022 are adjusted as follows:

- For people with pension, social insurance allowance, monthly allowance of 2,300,000 VND/person/month or less:

Pension, social insurance allowance, monthly allowance after adjustment = The adjusted pension, social insurance allowance, and monthly allowance before adjustment + 200,000 VND/month

- For people with pension, social insurance allowance, monthly allowance from over 2,300,000 VND/person/month or less to less than 2,500,000 VND/person/month:

The adjusted pension, social insurance allowance and monthly allowance = 2,500,000 VND/month.

Circular 37/2021/TT-BLDTBXH takes effect from March 15, 2022.
