Time limits for judicial expertise in science and technology-related activities in Vietnam

On April 20, 2022, the Minister of Science and Technology issued Circular 03/2022/TT-BKHCN providing for judicial expertise in science and technology activities in Vietnam.

Accordingly, the time limit for judicial expertise in scientific and technological activities in Vietnam is specified as follows:

- The maximum time limit for judicial expertise in scientific and technological activities in Vietnam is 03 months.

Where the case of inspection of new or complex equipment, machinery and technology or volume of work is large, the maximum time limit for inspection is 04 months.

The duration of this expertise may be extended according to the decision of the expertise-soliciting agency but shall not exceed half of the maximum expertise duration prescribed above.

Judicial expertise in scientific and technological activities in Vietnam in cases of compulsory solicitation of judicial expertise shall comply with the provisions of criminal procedure law.

- In case there are issues arising or grounds for presuming that the expertise case cannot be completed within the prescribed time limit, the individual or organization performing the expertise must promptly notify in writing specifying:

+ Reasons for the expertise solicitor;

+ Expected time of completion and conclusion of expertise.

The Circular No. 03/2022/TT-BKHCN dated June 15, 2022 and replace the Circular No. 35/2014/TT-BKHCN dated December 11, 2014.
