This is a notable content of Decree 107/2020/ND-CP on the amendment to a number of articles of Decree 24/2014/ND-CP regulating the organization of specialized agencies under the provincial level People's Committee in Vietnam.
According to Clause 3 Article 1 of Decree 107/2020/ND-CP amending and supplementing Article 5 of Decree 24/2014/ND-CP, there are specified criteria for the establishment of specialized and professional divisions affiliated to the departments in Vietnam as follows:
- Have functions and tasks related to advising on state management concerning the sectors and fields under the functions and tasks of the department.
- Regarding workload, the arrangement must be a minimum of 07 official staff for departments under the Hanoi City and Ho Chi Minh City department; at least 06 official staff for departments under the level I provincial department; at least 05 official staff for departments under the level II and level III provincial department.
Additionally, based on the number of departments established and the total number of Deputy Directors, the provincial People's Committee shall decide on the specific number of Deputy Directors for each department accordingly. For Hanoi City and Ho Chi Minh City, apart from the total number of Deputy Directors as regulated on average, each city can increase by no more than 10 Deputy Directors.
