The Supreme People's Procuracy of Vietnam instructs the exercise of the right to prosecution and supervision of investigation and first-instance trial of security courts in 2021

Recently, the Supreme People's Procuracy of Vietnam has just issued the Guidance No. 10/HD-VKSTC guiding the exercise of the right to prosecution and supervision of investigation and first-instance trial of security courts in 2021.

According to the Guidance No. 10/HD-VKSTC the Supreme People's Procuracy of Vietnam instructs the exercise of the right to prosecution and supervision of investigation and first-instance trial of security courts in 2021 as following:

- Continue to thoroughly grasp and strictly implement Directive 04/CT-VKSTC and Directive 05/CT-VKSTC;

- Strictly supervise the application of preventive measures in accordance with the provisions of the Criminal Procedure Code 2015 of Vietnam;

- In the process of solving the case, it is necessary to clarify the crime's acts, motives and purposes; the force behind directing, providing money and means; proactively request the assessment of documents, collect physical evidences (documents, electronic data, etc.) to prove the crime; carefully study the dossier, agree on the prosecution and application of preventive measures (area, subjects, etc.);

- Prosecuting on time of crime, penalty frame; avoid unjust prosecution, wrong, omission of criminals; the application, change, and cancellation of preventive measures during the legal prosecution phase, without allowing errors to lead to infringing upon human rights and citizens' rights, especially those with special identities;
