On 11/11/2022, the Ministry of Home Affairs of Vietnam issued Official Dispatch 5670/BNV-TCBC on the implementation of downsizing policy.
According to Official Dispatch 5670/BNV-TCBC, the Ministry of Home Affairs of Vietnam suggested that a number of ministries, branches, and localities need to streamline the payroll for the right subjects, properly apply the regimes and policies on downsizing staff, and follow the order and procedures prescribed by the law in Vietnam.
In addition, the Official Dispatch 5670/BNV-TCBC also stipulates the cases in which the downsizing of staff is not carried out, including:
- Not having completed professional training but still being assigned to work as civil servants, public employees, or commune-level cadres;
- Civil servants and public employees who have been evaluated for not completing their tasks for two years in a row but still propose to reduce payrolls;
- Civil servants and public employees who fail to perform their duties and request a payroll downsizing but are still entitled to regular salary increases in accordance with regulations;
- In areas with extremely difficult socioeconomic conditions, there is insufficient working time to reduce payroll at a retirement age lower than the retirement age under normal working conditions in Vietnam;
- Civil servants and public employees who are redundant due to organizational apparatus arrangements, but who are unable to clarify organizational arrangements, apparatus of agencies, organizations, units, and so on.
