On November 1, 2022, the Minister of Justice issued Circular 08/2022/TT-BTP on the Code of Professional Ethics for Bailiffs in Vietnam.
The Bailiff's relationship with the People's Procuracy and the People's Court is regulated as follows:
- Strictly complying with the supervision of the People's Procuracy in practice activities according to the provisions of law; Fully fulfill reporting obligations and provide records and documents to serve the People's Procuracy's inspection activities according to regulations.
- Being responsible for coordinating with the People's Court to organize the implementation of judgments and decisions of the Court at the request of the litigant according to the provisions of law.
- Closely coordinating with the People's Court and People's Procuracy in reviewing and evaluating the authenticity of documents; strictly implementing the service agreement signed between the parties.
In addition, regulations on the bailiff's relationship with civil judgment enforcement agencies include:
- Ready to cooperate and support work towards the highest work efficiency; for career development purposes.
- There must be no violations that adversely affect the image and reputation of the civil judgment enforcement agency.
- Actively exchanging and learning knowledge, experience, and skills to solve problems with civil judgment enforcement agencies.
- When detecting a person from a civil judgment enforcement agency committing violations in the performance of official duties, they must report to the responsible individual or agency for timely prevention and handling.
Circular 08/2022/TT-BTP takes effect on December 22, 2022.
