System of indicators on working conditions for labor classification in Vietnam

The Minister of Labor, Invalids, and Social Affairs of Vietnam promulgates Circular 03/2025/TT-BLDTBXH dated February 11, 2025, stipulating the standards for classifying labor according to working conditions.

System of indicators on working conditions for labor classification in Vietnam

The system of indicators on working conditions for labor classification is issued in Appendix I, promulgated with Circular 03/2025/TT-BLDTBXH.

The indicators on working conditions include the following groups:

- Group of factors assessing labor environmental hygiene

- Group of factors assessing the impact on labor psychophysiology

Some points to note when using the indicator table:

+ Data from the group of factors assessing labor environmental hygiene, Ergonomics - labor organization must be collected at three appropriate times.

+ Data from the group of factors assessing the impact on labor psychophysiology must be collected within the same shift (in cases where there are multiple shifts in a day) at three appropriate times.

+ Psychophysiological indicators must be collected from experiments with reasonable design and tools that ensure accuracy as required.

Types of working conditions according to the law in Vietnam

- Working conditions comprise 6 types as follows: Type I; Type II; Type III; Type IV; Type V; Type VI.

- Jobs with working conditions classified as Type I, II, III are jobs that are not arduous, not toxic, not dangerous; jobs with working conditions classified as Type IV are arduous, toxic, dangerous; jobs with working conditions classified as Type V, VI are particularly arduous, toxic, dangerous.

Circular 03/2025/TT-BLDTBXH takes effect from April 1, 2025.

Arduous, toxic, dangerous jobs according to the law in Vietnam

Article 22 of the Law on Occupational Safety and Hygiene stipulates the following regarding arduous, toxic, dangerous jobs:

Arduous, toxic, dangerous jobs, as well as particularly arduous, toxic, dangerous jobs, are classified based on the characteristic features and specific working conditions of each job.

The Minister of Labor, War Invalids and Social Affairs issues the List of arduous, toxic, dangerous jobs, and particularly arduous, toxic, dangerous jobs after obtaining opinions from the Ministry of Health; prescribes the standards for labor classification according to working conditions.

Employers must fully implement labor protection policies and health care for workers engaged in arduous, toxic, dangerous jobs, and particularly arduous, toxic, dangerous jobs according to the provisions of the law.
