Supreme People's Procuracy of Vietnam's guidelines on research of records, documents, books, and inspection reports in 2021

Recently, the Supreme People's Procuracy of Vietnam issued Decision 94/QD-VKSTC in 2021 on regulations on direct processes and skills to supervise at civil judgment enforcement agencies and supervise the settlement of complaints and denunciations about civil judgment enforcement and administrative judgment enforcement.

According to Vietnam's Decision 94/QD-VKSTC, when inspecting a judgment enforcement file, members of the team directly supervising the inspection must study and clarify some of the following basic contents:

  • Decisions on judgment enforcement; notification of judgment enforcement decisions; enforcement of judgments during the period of voluntary judgment execution;
  • Verification of judgment execution conditions and handling of verification results;

  • The application of security measures and measures to enforce judgments; the enforcer's assurance of the involved parties' rights in reaching an agreement on the value of the judgment-executed property; the selection of a price appraisal organization or an asset auction organization in Vietnam;

  • The execution of contracts on price appraisal and auction of assets, exercise of the right to inspect and supervise price appraisal and auction; the process of auctioning assets for judgment enforcement; the storage of price appraisal and auction dossiers at civil judgment enforcement agencies;

  • Complaints and denunciations; settlement of complaints and denunciations during judgment enforcement;

  • Supervising the accounting of judgment enforcement, including monitoring the system of accounting accounts for judgment enforcement, analyzing account balances for each case, checking if there is still money on the account but making decisions on conditional, late payment, untimely or non-deposit, or late refund of forced advance, etc.
