On July 15, 2024, Hanoi promulgated Decree 88/2024/ND-CP regulating recompense, support, and resettlement upon land expropriation by the State in Vietnam.

Support for life stabilization upon land expropriation by the State in Vietnam is provided as follows:

Households and individuals currently using agricultural land that are eligible for compensation for the land will receive life stabilization support as follows:

- If between 30% and 70% of the agricultural land area is reclaimed, support will be provided for 6 months if there is no need to relocate and for 12 months if relocation is necessary; in cases where relocation to areas with difficult socio-economic conditions or especially difficult socio-economic conditions is required, the maximum support period is 24 months.

In cases where more than 70% of the agricultural land area is reclaimed, support will be provided for 12 months if there is no need to relocate and for 24 months if relocation is necessary; in cases requiring relocation to areas with difficult socio-economic conditions or especially difficult socio-economic conditions, the maximum support period is 36 months;

- The area of agricultural land reclaimed to calculate life stabilization support as per the provisions mentioned above is the area within the boundaries of the commune, ward, or commune-level town where the land is reclaimed at the time the compensation, support, and resettlement plan is approved by the competent People’s Committee and determined according to each project requiring land expropriation, without cumulating the area of agricultural land reclaimed from previous land expropriation projects;

- The support level for one individual as stipulated in the two points mentioned above is calculated in cash equivalent to 30 kg of rice per month according to the average market price at the time of support in the locality.

Note: In cases where households and individuals currently using land as stipulated above have less than 30% of their agricultural land reclaimed; or households and individuals using land that do not qualify for compensation for land or were allocated land for agricultural, forestry, aquaculture, salt production purposes by state agricultural, forestry farms, or agricultural and forestry companies converted from state agricultural, forestry farms, agricultural production groups, agricultural cooperatives, and have land allocation contracts, the provincial-level People’s Committee will decide on the support level, support period, and the schedule for support payment to suit each specific case, but it shall not exceed the support levels as stipulated.

More details can be found in Decree 88/2024/ND-CP, which comes into force in Vietnam from August 1, 2024.
