The Ministry of Transport of Vietnam issued Circular No. 17/2017/TT-BGTVT on requirements for foreign seafarers working onboard Vietnamese-flagged ships.
According to Circular No. 17/2017/TT-BGTVT of the Ministry of Transport of Vietnam, in addition to current requirements, a foreign seafarer must also meet the following ones:
- possess a working permit granted by a competent authority of Vietnam, except for exemption cases as regulated by the labor law;
- have a seafarer’s employee agreement;
- be assigned to hold a position onboard a ship;
- Foreign seafarers who undergo practical training onboard Vietnamese-flagged ships must also possess Certificate of professional training.
According to Circular No. 17/2017/TT-BGTVT, the ship owner is the person who signs the labor contract with the seafarer and shall fulfill all obligations as agreed upon and specified in the seafarer's employment agreement, which is different from the current regulations that only stipulate the crew hire contract between the charterer and the foreign seafarer.
Circular No. 17/2017/TT-BGTVT of the Ministry of Transport of Vietnam takes effect from July 15, 2017, replacing Decision No. 47/2005/QĐ-BGTVT dated September 23, 2005.
