Supplementary Regulations on Technical Requirements for Riverbed Sand and Gravel Exploration Effective from June 06, 2024

Circular 02/2024/TT-BTNMT has added Clause 8 to Article 4 of Circular 01/2016/TT-BTNMT, which specifies the forecast of impacts on the riverbed, banks, and beaches within the technical requirements for riverbed sand and gravel exploration, as well as soil and rock used for land filling as follows:

- The riverbed sand and gravel exploration scheme includes the requirements stipulated in Clauses 1 through 7 of Article 4 of Circular 01/2016/TT-BTNMT and the respective tasks to assess and forecast impacts on the riverbed, banks, and beaches according to the management and protection regulations of riverbed sand and gravel, and riverbed and bank protection, including:

+ Establish monitoring stations or collect data on hydrodynamic and seasonal characteristic hydrological policies, and current data on sedimentation rates of the riverbed;

+ Survey current conditions or collect data on geological hazards, including phenomena such as erosion, subsidence, riverbank and riverbed erosion.

- Establish calculation models to simulate hydrodynamic processes (water levels, flows), sediment transport, and morphological changes of the river (erosion, sediment deposition) and the dispersion of suspended matter caused by exploitation activities to determine anticipated sedimentation volumes, and reasonable extraction distances, depths, and capacities.

For organizations and individuals who have been granted exploration permits for riverbed sand, gravel, soil, and rock used for land filling by competent state authorities before June 06, 2024, they shall continue to comply with the legal provisions at the time the permits were issued.

Riverbed sand and gravel exploration schemes and soil and rock for land filling that have been received by competent state authorities before June 06, 2024, but have not yet been appraised or granted exploration permits, shall continue to adhere to the legal provisions at the time of receipt.
