The National Assembly of Vietnam approved the Resolution 96/2023/QH15 dated June 23, 2023 on the collection and casting of votes of confidence on persons holding positions elected or approved by the National Assembly or People’s Councils
The regulations on the subjects of collection and casting of votes of confidence in Vietnam are as follows:
(1) The National Assembly takes a vote of confidence in the following persons holding the following positions:
- State President, Vice President;
- The President of the National Assembly, Vice President of the National Assembly, Member of the Standing Committee of the National Assembly, Secretary General of the National Assembly, Chairman of the Council for Ethnic Minorities, Chairman of Committees of the National Assembly;
- Prime Minister, Deputy Prime Minister, Minister, and other members of the Government;
- The Chief Justice of the Supreme People's Court, the Chief Procurator of the Supreme People's Procuracy, and the State Auditor General.
(2) The People's Councils of provinces and districts shall take votes of confidence from the following persons holding the following positions:
- The President of the People's Council, the Vice President of the People's Council, and the Head of the Committee of the People's Council of the province and district;
- Presidents of People's Committees, Vice Presidents of People's Committees, and members of People's Committees of provinces and districts.
(3) The National Assembly and People's Council cast a vote of confidence in the person holding a position elected or approved by the National Assembly or the People's Council in the cases specified in Article 13 of Resolution 96/2023/QH15.
(4) In the event that a person holds multiple positions at the same time as specified in paragraphs (1) and (2) above, the vote of confidence is carried out once for all those positions.
(5) Not collecting vote of confidence for the person holding the position specified in paragraphs (1) and (2) above who has received a notice of resignation pending retirement or was elected or appointed in the year of taking the vote of confidence.
- Ensuring the rights and upholding the responsibilities of National Assembly deputies and People's Council deputies in taking votes of confidence and voting of confidence; ensuring the right to report and give explanations of the person receiving the vote of confidence or vote of confidence.
- Democracy, objectivity, fairness, openness, and transparency; to ensure the true assessment of the results of the performance of tasks, powers, and political, moral, and lifestyle qualities of the person eligible for collection and casting of votes of confidence in Vietnam
- Ensuring the stability and operational efficiency of the state apparatus and the Party's leadership in cadre work.
