Subjects eligible for applying the new base salary from July 1, 2023 in Vietnam

Circular 10/2023/TT-BNV guiding the implementation of the base salary for the subjects receiving salaries and allowances in agencies, organizations and public non-business units of the Party, State, Vietnam Fatherland Front, socio-political organizations and associations promulgated by the Minister of Home Affairs on June 26, 2023.

Subjects eligible for applying the new base salary from July 1, 2023 in Vietnam

Subjects eligible for applying the new base salary from July 1, 2023 in Vietnam, include:

- Cadres and civil servants receiving salaries from the state budget working in Party and State agencies, the Vietnam Fatherland Front, and socio-political organizations at the central level; in provinces and centrally run cities; in rural districts, urban districts, towns, provincial cities, and cities under centrally-run cities; in special administrative - economic units.

- Public employees receive salary from the salary fund of public non-business units as prescribed by law (including the case specified in Clause 19, Article 1 of the Law amending and supplementing a number of articles of the Law on Cadres and Public Employees and the Law on Public Employees in 2019).

- Cadres, civil servants, and public employees who are sent by competent authorities to work at associations, non-governmental organizations, projects, and international agencies and organizations located in Vietnam and still receive salary according to the salary table promulgated together with Decree 204/2004/NĐ-CP.

- People working in the quota of payroll assigned by competent authorities at associations assigned by the Party and State are supported by the state budget according to the provisions of Decree 45/2010/NĐ-CP (amended by Decree 33/2012/NĐ-CP).

- Cadres and civil servants in communes, wards, and townships and those who work part-time at communes, villages, and residential groups are prescribed in the following documents:

+ From July 1, 2023, comply with the provisions of Decree 92/2009/NĐ-CP (amended  by Decree 34/2019/NĐ-CP).

+ From August 1, 2023, comply with the provisions of Decree 33/2023/NĐ-CP.

- Delegates of the People's Councils at all levels are entitled to operating fees in accordance with current law.

- People working in cipher organizations.

- People who perform jobs under the labor contract regime specified in Decree 111/2022/NĐ-CP in cases where it is applicable or agreed in the labor contract to apply salary classification according to Decree 204/2004/ND-CP.

- The following subjects are entitled to apply the new base salary to calculate and determine the payment rate, enjoy the social insurance regime, and settle salary-related benefits as prescribed by law:

+ Cadres, civil servants, and public employees who go to school, practice, work, receive treatment, and nurse (domestic and foreign) on the list of paid salaries of Party and State agencies, socio-political organizations, public non-business units, and associations supported by the state budget for their operation;

+ Persons who are in probationary period or on probation (including traineeship of commune-level civil servants) in Party and State agencies, socio-political organizations, public non-business units, and the association is supported by the state budget for operating expenses;

+ Cadres, civil servants, and public employees who are temporarily suspended from work, are held in custody or temporarily detained.

Circular 10/2023/TT-BNV takes effect as of July 1, 2023, and replaces Circular 04/2019/TT-BNV.
