On July 24, 2024, the Minister of Construction of Vietnam issued Circular 03/2024/TT-BXD providing guidance on the Management Council and the criteria, conditions for appointment, and dismissal of members of the Management Council in public service providers in the construction sector.
Under Article 5 of Circular 03/2024/TT-BXD, the structure and term of the Management Council in public service providers within the construction sector in Vietnam are specified as follows:
- The structure of the Management Council includes:
+ Representatives from the supervisory authority of the public service provider, including representatives from the ministry, ministry-level agencies, agencies under the Government of Vietnam, organizations established by the Government of Vietnam, the Prime Minister of Vietnam, not being public service providers, the Provincial People's Committee, and the direct supervisory authority (if any); working on a part-time basis;
+ The head of the public service provider;
+ Officials of the public service provider;
+ Representatives of related organizations and units.
- The number of members of the Management Council ranges from 05 to 11 individuals, including the Chairman of the Management Council, the Secretary of the Management Council, and other members of the Management Council. Depending on task requirements, the Management Council may have a Vice Chairman. The specific number and structure of members of each public service provider's Management Council are decided by the head of the authority who approves the self-governance scheme of the public service provider.
The Chairman and the members of the Management Council are selected and appointed by the head of the authority who approves the self-governance scheme of the public service provider from among the leadership representatives of the public service provider or the supervisory authority of the public service provider.
The Vice Chairman of the Management Council (if any), the Secretary of the Management Council, and the members of the Management Council are appointed by the head of the authority who approves the self-governance scheme of the public service provider.
- The term of office for members of the Management Council is not more than 05 years.
