Standards for members of the Management Council in public service units in the industry and trade sector

Instructions on standards and conditions for appointing members of the Management Council in public service units in the industry and trade sector are as follows:

(1) Standards and conditions for appointing members of the Management Council in public service units in the industry and trade sector:

- Having good political and moral qualities; being healthy enough to undertake the job;

- Having worked in the industry, trade, or related fields for 3 years or more;

- Having a university degree or higher;

- Being a civil servant or public employee;

- Not while serving the disciplinary decision or within the disciplinary time limit as prescribed by law;

- Meeting the age requirement to work for at least 01 term of the Management Board (in case of a new appointment) and meet the remaining time of the Management Board term (in case of replacing members of the Management Board);

- Not being the spouse, biological parents, adoptive parents, biological children, adopted children, siblings, siblings-in-law of the head, deputy of the head, chief accountant
of public service units.

(2) Standards and conditions for appointing the Chairman of the Management Board in public service units in the industry and trade sector:

- Meeting the standards and conditions for appointing members of the Management Board;

- Meeting the conditions and standards as the head of a public service unit according to the provisions of law and regulations of competent authorities;

- The Chairman of the Management Board must not be the head of a public service unit at the same time.

Cases of dismissal of members of the Management Council in public service units in the industry and trade sector

Dismiss members of the Management Council in public service units in the industry and trade sector if they fall into one of the following cases:

- Having limited legal capacity;

- Not healthy enough to undertake the assigned work, having to take leave from work for medical treatment for more than 6 months, but the ability to work has not yet recovered;

- Being convicted by a court of law by a legally effective sentence;

- There are other violations specified in the regulations on the organization and operation of public service units and the operating regulations of the Management Council;

- Other cases as prescribed by law or the Party.

Circular 46/2023/TT-BCT takes effect on February 15, 2024. Management councils in public service units in the industry and trade sector that were established before the effective date of Circular 46/2023/TT-BCT will continue to operate until the end of their term; Review and adjust the operating regulations of the Management Council to ensure compliance with Circular 46/2023/TT-BCT.
