Standards for judicial expertise under cases in the field of Natural Resources and Environment in Vietnam

The Ministry of Natural Resources and Environment of Vietnam has promulgated Circular 15/2021/TT-BTNMT dated August 31, 2021 regulating judicial expertise in the field resources and environment.

According to this Circular, Vietnamese citizens permanently residing in Vietnam who fully meet the following criteria may be selected as judicial experts under cases in the field of natural resources and environment:

- Having good health and moral qualities;

- Having a university degree or higher and having practised professionally in the field of training in the field of assessment for full 05 years or more from the date of appointment to the rank of officials or public employee.

If a person who does not have a university degree but has in-depth knowledge and practical experience in the field of expertise, he or she may be selected to act as a case-by-case judicial expert in the field of natural resources and environment. (New content compared to Circular 44/2014/TT-BTNMT ).

The judicial expertise under the case has been recognized and posted on the Portal before October 15, 2021, if the above criteria and conditions are still met, the procedures for recognition of judicial expertise persons are not required according to the case.

Circular 15/2021/TT-BTNMT of Vietnam takes effect from October 15, 2021 and replaces Circular 44/2014/TT-BTNMT ; Circular 45/2014/TT-BTNMT of Vietnam.
