On August 31, 2024, the Minister of Labor, War Invalids, and Social Affairs of Vietnam issued Circular 09/2024/TT-BLDTBXH guiding the staffing norms for public service providers in the fields of labor, people with meritorious services, and social affairs.
Occupational safety and health-related public service providers, based on the actual situation of the unit, the functions, duties, organizational structure, and the downsizing schedule (if any), shall determine the minimum number of employees for each job position and the minimum number of employees in the unit, ensuring compliance with the following regulations:
Ensure the minimum number of employees in the unit is 15 (excluding public service providers offering essential, basic public services established according to the specialized legal provisions).
- The principle of determining the number of workers in public service providers in the labor, war invalids, and social affairs sector is based on the principles stipulated at point d, clause 1, Article 5 and points d, clause 1, clause 2, and clause 3, Article 6 of Decree 120/2020/ND-CP regulating the establishment, reorganization, and dissolution of public service providers.
- The basis for determining the number of workers in public service providers in the labor, war invalids, and social affairs sector shall comply with the provisions of clause 5, Article 3 and clause 2, Article 4 of Decree 106/2020/ND-CP regarding job positions and the number of workers in public service providers.
- Based on the complexity of the work and the number of workers needed to be arranged for each job position in public service providers in the labor, war invalids, and social affairs sector as approved by the competent authority.
- Ensure consistency and synchronization with specialized legal provisions in the labor, war invalids, and social affairs sector.
