Six Forms of Official Discipline in Administrative Enforcement

From July 1, 2016, Decree 71/2016/ND-CP stipulates the duration, sequence, and procedures for the execution of administrative judgments (THAHC) and the handling of responsibilities for individuals who fail to execute court judgments and decisions.

disciplinary actions against officials and public employees (CC, VC) who violate as follows:

- Depending on the nature and extent of the violation, CC, VC may be disciplined in one of the 6 following forms:- Reprimand;- Warning;- Salary reduction;- Demotion;- Dismissal;- Forced resignation.

- Apply the regulations on disciplining CC, VC to matters related to disciplining CC, VC in administrative enforcement cases that are not stipulated in this Decree;- Apply disciplinary measures, authority, and procedures for disciplining violating officials in administrative enforcement cases in accordance with legal provisions, the Communist Party's regulations, political-social organization charters, and documents of competent authorities;- Send the disciplinary results to the Court of first instance, the Procuracy, and the civil enforcement agency at the same level as the Court of first instance.
