Roadmap for the Application of Official Safeguard Duties on Fertilizer Products

On March 02, 2018, the Ministry of Industry and Trade signed Decision No. 686/QD-BCT to officially apply safeguard measures on DAP and MAP fertilizers with HS codes: 3105.10.20; 3105.10.90; 3105.20.00; 3105.30.00; 3105.40.00; 3105.51.00; 3105.59.00; 3105.90.00 imported into Vietnam.

The Minister of Industry and Trade decides to apply official safeguard measures in the form of additional import tax with the tax schedule as follows:

- From August 19, 2017, to March 6, 2018: 1,128,531 VND/ton;- From March 7, 2018, to March 6, 2019: 1,128,531 VND/ton;- From March 7, 2019, to March 6, 2020: 1,072,104 VND/ton;- From March 7, 2020, onwards: 0 VND/ton (if not extended).

Note: Fertilizer products with any of the following component contents will not be subject to official safeguard measures: Nitrogen (N) < 7%; Phosphorus (P2O5) < 30%; and Potassium (K2O) > 3%.

Organizations and individuals importing fertilizers have the right to submit a dossier requesting to be exempt from the application of safeguard measures if they believe that their imported products have different characteristics from similar goods produced domestically but share the same HS code.

Decision 686/QD-BCT comes into effect on March 7, 2018.
