The Ministry of Transport recently promulgated Circular 37/2018/TT-BGTVT on the management, operation, exploitation, and maintenance of road works. Notably, it outlines the responsibilities of relevant organizations and individuals in the event of a traffic accident occurring on road works.
To be specific, when a traffic accident occurs, the owner of the infrastructure, the manager, the contractor responsible for maintaining the infrastructure, and any other relevant organizations or individuals have the responsibility to protect the scene and simultaneously:
- Quickly assist the victims and protect their property, notify the nearest police, medical authority, or People's Committee; provide truthful information about the accident as required by the competent authority;- Promptly notify the nearest Traffic Police and the road management authority about the accident and any damage to the road infrastructure caused by the accident (if any);- Guide people and vehicles participating in traffic to pass through the accident area or avoid the accident area.
Circular 37/2018/TT-BGTVT is effective from July 24, 2018, replacing Circular 52/2013/TT-BGTVT and Circular 20/2014/TT-BGTVT.
