Responsibilities and rights of agencies inspecting tobacco trading in Vietnam

Recently, the Ministry of Industry and Trade of Vietnam issued Circular No. 57/2018/TT-BCT on elaboration of Decrees on tobacco trading.

According to Circular No. 57/2018/TT-BCT of the Ministry of Industry and Trade of Vietnam, each inspecting agency shall have the following responsibilities and rights:

- Formulate the inspection plan and submit it to a competent authority for approval.

- Make decision on establishment of inspection teams to carry out planned or unscheduled inspections.

- Make decision on suspension of trading in tobacco products within 07 (seven) business days from the receipt of reports from the inspection team.

- Take actions against violations discovered during the inspection of tobacco trading in accordance with relevant laws.

- Inform relevant organizations and individuals of inspection results/ conclusions.

- Settle complaints/denunciations of decisions made by inspection teams or behaviors of members of an inspection team in accordance with the Law on complaint and denunciation.

View more details at Circular No. 57/2018/TT-BCT of the Ministry of Industry and Trade of Vietnam, effective from February 19, 2019. In particular, regulations on templates of applications and lists included in applications for License to manufacture tobacco products, and template of License to manufacture tobacco products herein shall come into force from January 01, 2020.
