Research on completing regulations on duties and powers of the School council and management board of the university in Vietnam is mentioned in Resolution 38/NQ-CP dated April 02, 2024, on the Action Program of the Government of Vietnam to implement Conclusion 62-KL/TW of 2023, which implements Resolution 19-NQ/TW of 2017 on continuing to innovate the organizational and management system, enhancing the quality and efficiency of operations of public service providers.
In the tasks and solutions on perfecting the law on managing public service provider organizational structure, the following are identified:
- The Ministry of Education and Training researches to perfect regulations on the responsibilities and authorities of the School council and management board of the university during the review, amendment, and supplementation of the Higher Education Law 2012 to ensure feasibility and effectively resolve the relationship between the University Council and the University Board of Directors in higher education institutions.
- Ministries and ministerial agencies:
(i) Complete the issuance of regulations on specific criteria for classification, conditions for establishment, reorganization, and dissolution of public service providers by sector and field;
(ii) Provide guidance on the functions, tasks, authorities, organizational structure, and operating regulations of the Management Council, the relationship between the Management Council and the head of the public service provider, and the superior management agency; stipulate standards and conditions for the appointment and dismissal of members of the Management Council and the President of the Council in public service providers under the sectors and fields.
- The Ministry of Home Affairs presides, cooperates with ministries, and related agencies to review and evaluate specialized legal documents with regulations on providing public service, public service providers by sector and field to compile and research the necessity of developing a common legal document for adjusting both public and non-public service providers.
