On February 09, 2024, the Government of Vietnam issued Resolution 22/NQ-CP of the special session on law-making in January 2024.
The Government of Vietnam requires the Ministry of Justice to continue researching, revising, and completing the draft Law with the following requirements:
- Fully institutionalize the policies and directives of the Communist Party and the Government of Vietnam on judicial reform, administrative reform, and private investment in notarization activities;
- Adhere closely and clearly to the 05 Policies approved by the Government of Vietnam in the Proposal for the building of the Law on Notarization (Amended) in Resolution 126/NQ-CP dated September 27, 2022, regarding the special law-making session of September 2022;
- Inherit the provisions of the 2024 Law on Notarization that have been effectively applied in practice; supplement regulations to address shortcomings and obstacles in the implementation of the current Law on Notarization; clarify the political, legal, and practical basis, with scientific evidence and rationale for the amended and supplemented contents;
- Review to ensure the uniformity and consistency of the legal system, especially laws closely related to notarization activities such as: Civil Code, Land Law, Law on Real Estate Business, Law on Housing...; ensure the feasibility and effectiveness of the provisions in the draft Law. The language in the draft Law should be clear, concise, easy to understand, and easy to apply, facilitating citizens in notarizing civil transactions;
- Strengthen decentralization and devolution along with resource allocation; reform administrative procedures, creating convenience for citizens, businesses, and other entities when conducting notarization;
- Refer to international experiences and thoroughly evaluate the notarization models and processes of advanced countries to apply appropriately to Vietnam's socio-economic conditions;
- Consult with experts, scientists, and practitioners; promote policy communication to create consensus; effectively coordinate with ministries and central authorities and related agencies to complete the draft Law.
