On August 2, 2023, the Minister of Public Security issued Circular 36/2023/TT-BCA regarding the procedures for patrol, security check, and handling administrative violations by the Waterway Police. Among the contents, there are requirements for the Waterway Police when stopping vehicles for security check
When stopping vehicles for security check, the Waterway Police must ensure the following requirements:
- Safety, compliance with the law, and without causing obstructions to traffic activities. Once the vehicle has been stopped, the security check and handling of violations (if any) must be conducted in accordance with the law;
- Choose a control location that requires a deep, wide, clear channel, unobstructed visibility; ensure that the vehicle stopping and control process is public and transparent;
- In cases where the vehicle transporting flammable, explosive, hazardous substances, or other dangerous goods is stopped for security check, in addition to fulfilling the requirements at points a and b of this section, safety measures must be taken to guide the vehicle away from residential areas or places with few people to stop, then proceed with the security check.
Officers performing patrol and control duties according to the plan are allowed to stop vehicles for security check in Vietnam in the following cases:
- Directly detecting or through technical means and professional equipment detecting and recording signs of legal violations;
- Implementing directives, patrol and control plans, and work plans approved by the Division Commander, the Head of the Traffic Police Department, or the Head of the District Police;
- Having a written request to stop the vehicle from the Chief or Deputy Chief of the Investigative Agency at all levels, or relevant functional agencies, for security check to serve the task of protecting national security, and maintaining public order and safety;
- Receiving reports or allegations of legal violations related to people and vehicles participating in traffic.
