On August 14, 2024, the Supreme People's Court of Vietnam issued Directive 05/2024/CT-CA regarding the enhancement of execution of criminal judgments in the Courts in Vietnam

Request regarding enhancement of execution of criminal judgments in the Courts in Vietnam

To improve the quality of performing the tasks and powers of the Court in execution of criminal judgments, the Chief Justice of the Supreme People's Court of Vietnam has requested the following actions:

- Direct the review and summary of the implementation of the tasks and powers of the Court in execution of criminal judgments at the agencies and units; focus on reviewing the issuance of execution of criminal judgments decisions, especially cases where decisions have not yet been issued by the Court and cases where the enforcement has been delegated without results;...

- Direct and thoroughly explain to all officials in the unit to strictly comply with the regulations and guidelines on execution of criminal judgments; strengthen capable and responsible staff to advise and assist the Chief Justice in execution of criminal judgments, recording in the registry, monitoring enforcement, and conducting regular inspections;...

- Direct and thoroughly explain to Judges that immediately upon the conclusion of the criminal trial, they must complete and deliver the conformable judgment.

Courts that have tried appeals, cassation, or retrials of criminal cases must promptly send judgments and decisions to the court that handled the first-instance trial to ensure that the judgments and decisions are implemented promptly and in accordance with the law.

- Closely coordinate with related agencies, especially the Police and the Procuracy, to verify, provide related information and documents; monitor and supervise the issuance, service, and transfer of execution of criminal judgments decisions; promptly resolve arising difficulties and obstacles.

- Strengthen discipline and administrative compliance; intensify inspection and supervision of professional execution of criminal judgments activities, promptly detect errors, propose remedies, prevent and handle violations.
