On March 3, 2021, the Government of Vietnam issued Decree 16/2021/ND-CP detailing the rate of collection and the procedures for collection and payment; the management and use of expenses for conciliation and dialogue at court; and the remuneration of mediators at Court.
According to this decree, the government of Vietnam specifically stipulates the remuneration of mediators at the court as follows:
The mediator is compensated on a case-by-case basis after conducting a conciliation session, a dialogue in accordance with the Law on Conciliation, and a dialogue at the court, with remuneration including:
(1) For the case of termination of conciliation and dialogue as prescribed in Clause 1, Article 40 of Vietnam's Law on Conciliation and dialogue at court, from VND 1,000,000/case to a maximum of VND 1,500,000/case.
(2) For cases of conciliation and dialogue termination as prescribed in Clause 6, Article 40 of Vietnam's Law on Conciliation and Dialogue at Court: from 500,000 VND to less than 1,000,000 VND per case.
The Supreme People's Court shall guide the People's Courts to pay the specific remuneration in items (1) and (2) above, based on the number of mediation sessions and dialogues and the complicated nature of the conciliation and dialogue case.
(3) For the case of termination of conciliation and dialogue as prescribed in Clauses 2, 3, 4 and 5, Article 40 of the Law on Conciliation, and dialogue at court: 500,000/01 case.
