Regulations on the management and maintenance of technical infrastructure works shared with roadways in Vietnam

The management, operation, exploitation, and maintenance of shared technical infrastructure works in Vietnam are conducted according to the provisions outlined in Clause 4, Article 20, Articles 35, 36, and 37 of the Law on Road Traffic 2024, the laws concerning fire prevention and fighting, the laws on the maintenance of construction works, and other relevant legal provisions, as well as the provisions of Decree 165/2024/ND-CP.

- The costs for managing, operating, exploiting, maintaining shared technical infrastructure works, and other installation components into road bridges, cable ducts, ditches, and technical tunnels of road tunnels as prescribed in Clause 3, Article 20 of the Law on Road Traffic 2024 are implemented based on the principles outlined at Point dd, Clause 4, Article 20 of the Law on Road Traffic 2024.

- The owner or the person managing or using the infrastructure works installed into shared technical infrastructure is responsible for the costs and the implementation of management and maintenance of such infrastructure works, unless otherwise specified by the installation contract.

- The owner, the person assigned to manage or use the shared technical infrastructure works, road managers and users, and other organizations and individuals are based on the recognition signs prescribed in Clause 3, Article 16 of Decree 165/2024/ND-CP to promptly notify the owner or the manager, allowing the repair of damages and providing information for coordination in managing, operating, exploiting, using, and maintaining the types of infrastructure works installed in the shared technical infrastructure works, ensuring the safe and efficient exploitation of the works.

Decree 165/2024/ND-CP takes effect from January 1, 2025.
